If you lose your H1B job, you have exactly 60 days to act. Here's your timeline:
W1
Week 1 โ Immediate
Get your termination letter in writing. Confirm your last day of employment. Contact your immigration attorney immediately. Do NOT accrue unlawful presence.
W2
Week 2 โ File or Transfer
Begin H1B transfer if you have a new employer. Alternatively, file for change of status (B-2 visitor or F-1 student) before Day 60 if you need more time.
W4
Week 4 โ Backup Plan
If no employer yet, ensure your attorney has filed for status change. Begin OPT/CPT consideration if you qualify. Explore startup options (O-1 visa).
D60
Day 60 โ Hard Deadline
Must have filed H1B transfer or change of status. After this date, you begin accruing unlawful presence. Do not travel internationally if status is uncertain.
